Terms of Service

These Terms govern your use of Modern Holistic Academy ("MHA," "we," "us") websites, educational programs, student portal, certificates, downloadable resources and related services. By purchasing or using a paid program, you agree to these Terms. The seller identified on your Stripe receipt or other purchase record is the contracting operator for that transaction.

Educational service only

MHA provides education and non-clinical wellness-coaching training. The Holistic Wellness Coach Certification is a certificate of completion issued by MHA. It is not a healthcare license, psychotherapy credential, dietetics credential, government license, NBHWC board certification, or authority to diagnose, treat, prescribe, or practice a regulated health profession.

You are responsible for understanding the laws, protected titles, licensing rules, scope-of-practice requirements and business obligations that apply where you live or work. Completing an MHA program does not override those requirements.

No medical or mental-health advice

Course content is educational and does not replace individualized care from qualified health professionals. Do not use the course to diagnose or treat yourself or another person, change medication, manage an emergency, or delay appropriate medical or mental-health care. In an emergency, use the appropriate emergency services for your location.

Purchases and access

Prices and included materials are shown before checkout. Payments are processed through Stripe. Access is activated after successful payment. You are responsible for using an email address you control and for maintaining access to it because secure sign-in links are sent to the purchase email.

Where an offer describes "lifetime access," this means ongoing access to the purchased digital program for as long as MHA continues to operate and make that program available on its platform, subject to these Terms, lawful discontinuation, refunds, security measures and circumstances beyond reasonable control. It is not a guarantee that a particular technology platform or business will exist indefinitely.

Course progression and assessments

Certification requirements may include completing lessons, passing module knowledge checks, passing a final assessment and providing a certificate name. Current requirements are displayed in the student portal. MHA may correct errors, update educational content, improve assessments, or revise materials to keep the program accurate and useful, provided previously earned certificates are not misrepresented.

Certificates

A valid certificate confirms completion of the MHA program and its assessment requirements at the time it was issued. Certificates may include a public verification ID, recipient name, issue date and final score. Certificates may be revoked or marked invalid when the underlying enrollment is refunded, revoked for fraud, or otherwise invalidated under these Terms.

You may accurately state that you completed the named MHA educational program. You may not represent the certificate as a medical license, government credential, NBHWC board certification, or another accreditation that MHA has not expressly granted.

Refunds

The current founding enrollment offer includes the published 30-Day Refund Policy. Refund eligibility and the effect of a refund on access and certificates are described there. Mandatory consumer rights that apply in your jurisdiction are not limited by these Terms.

Acceptable use

You may use purchased materials for your own learning and, where a resource is expressly described as editable or client-facing, customize that resource for your own legitimate practice use. Unless MHA expressly permits otherwise, you may not:

Intellectual property

The website, curriculum, written lessons, assessments, branding and non-editable course resources are protected by applicable intellectual-property laws. Purchasing access gives you a limited, personal, non-transferable right to use the materials as described in these Terms; it does not transfer ownership of the course content.

Optional practice resources

The Client Practice Starter Kit contains templates intended to be customized. Templates are educational starting points, not legal, medical, tax, insurance or regulatory advice. You are responsible for adapting them to your jurisdiction, credentials, business model, privacy obligations and client population and for obtaining professional advice where needed.

No guarantee of professional or financial results

MHA does not guarantee employment, clients, revenue, business success, licensure, admission to another credential, health outcomes, or any particular professional result from completing a program. Results depend on many factors outside MHA's control.

Account suspension and termination

MHA may restrict or terminate access when reasonably necessary to address fraud, chargebacks, security abuse, material violations of these Terms, unlawful activity, or misuse that threatens the service or other users. Where appropriate, we may provide notice or an opportunity to resolve the issue. Nothing in this section limits mandatory consumer rights.

Third-party services

The service relies on third parties such as Stripe for payments, Cloudflare for hosting and database infrastructure, and Resend for transactional email. Their services may be subject to separate terms and availability. MHA is not responsible for third-party services beyond obligations imposed by applicable law.

Disclaimers

To the maximum extent permitted by law, the service is provided on an "as available" basis. We aim to provide accurate, useful educational content but do not warrant that every item will remain error-free, uninterrupted, or suitable for every purpose or jurisdiction. We may correct errors and update content.

Limitation of liability

To the maximum extent permitted by applicable law, MHA and the transaction operator will not be liable for indirect, incidental, special, consequential, exemplary or lost-profit damages arising from use of the service. Where liability cannot lawfully be excluded, any limitation applies only to the extent permitted by law. Nothing in these Terms excludes liability or remedies that cannot legally be excluded or limited.

Changes

We may update these Terms for future use of the service as features, laws or business practices change. Material changes will be reflected by an updated effective date. Changes do not remove rights already provided by mandatory law.
